Terms, Conditions and Policies

General
These Terms and Conditions shall apply to all work carried out in the provision of services by go.courses ltd to the Customer in accordance with any booking form signed by or authorised with a Purchase Order No. by a representative of the Customer. No additions to, or modifications of, these Terms and Conditions shall have effect unless expressly agreed in writing by both parties and expressed to be amendments to these Terms and Conditions. go.courses ltd employees or agents are not authorised to make any representations whatsoever concerning the provision of services unless confirmed by go.courses ltd in writing. The Customer acknowledges that it does not rely on, and waives any breach of, any such representations that are not so confirmed.

Course booking
Bookings can be accepted at any time up to the course start date, subject to availability. An authorised* booking form must be received from the Customer within 5 days of the provisional booking being made. The authorised* booking form represents acceptance by you and confirms your place. go.courses ltd reserves the right to allocate provisional places to other Customers if provisional places have not been confirmed. Confirmed bookings can be made by letter, fax or email - additionally, provisional bookings can be made by telephone. On receipt of an authorised booking form, joining instructions will be sent to the delegate(s).

Payment terms
Full payment is required prior to the start of the course unless agreed otherwise in writing. All prices quoted are exclusive of VAT.   Some courses are offered in UK Pounds Sterling and some courses outside the UK are offered in Euro's.  The currency is clearly displayed against each course.  Late payment charges are 1.6% interest per month overdue.

Delegate suitability
It is the Customer's responsibility to ensure that the course is suitable for their requirements. All delegates should have read and understood the course outline and met then necessary prerequisites. Delegates who do not meet the course prerequisites may be asked to leave by the training provider. go.courses ltd urges clients to support this policy, which is designed to protect the Customer's investment.

Delegate substitutions
Delegate substitutions may be made prior to the start of the course without penalty, providing that the replacement delegate is suitable (see "Delegate suitability" above).

Delegates from overseasgo.courses ltd terms and conditions apply to any delegate travelling from overseas and, therefore, go.courses ltd is not liable for any difficulties relating to obtaining work visas or travel permits. 

Training times
Delegates will be advised of the start and finish times of courses in joining instructions.

Course descriptions and Course changes
The go.courses ltd Course Directory is provided for information purposes only and does not constitute an offer for a particular course or programme. go.courses ltd constantly strives to keep the content of its course directory up-to-date and therefore reserves the right to modify the specification of a course without notice to the Customer. The course title, duration, cost, content and location are liable to change at any time without notice, in which case the client may be charged for any subsequent increase in course costs.

We reserve the right to replace a live class with a virtual or connect solution which is fully authorised by the vendor.

Advanced course payments are made to secure discount rates and do not guarantee an event will run with a 3rd party . These are non refundable. In the event of a cancellation a suitable substitution may be offered or a credit that can be used for up to 6 months.

Course manuals and materials
Course manuals and materials may vary from the course descriptions listed within the go.courses ltd website and therefore go.courses ltd will not be held liable for any differences between course descriptions and course manuals and materials.

Engaging with go.courses ltd trainers
Customers of go.courses ltd must not try to contract directly with go.courses ltd trainers or associate trainers outside the terms of our booking agreement. Any customer who is found to be doing this will be in breach of the training contract and go.courses ltd will undertake legal proceedings as appropriate.

Between 13 & 15 working days - 50% Transfer Fee / 50% Cancellation fee
Between 0 & 12 working days - 100% Transfer Fee / 100% Cancellation fee

Refund Policy

Any business or consumer requesting a refund from us must send an email to us requesting their refund.   Providing the customer’s refund request falls outside of our cancellation or transfer period we will issue a full refund immediately. If a customer requesting a refund does fall into our cancellation and transfer period we will issue a refund minus any charges as clearly stated in the cancellation and transfer policy. 

Operating during Covid-19 pandemic.

During the Covid-19 pandemic go courses will be operating as normal as is possible, however, we may not be able to answer our customer service call lines so please send us an email and we will respond when we can. There may be delays during this time so we ask all customers and suppliers to exercise reasonable consideration. Any course bookings which cannot take place due to public health advice will be valid for virtual delivery or rescheduled to a later date.

A delegate may be substituted by another delegate prior to the commencement of the course providing they meet the pre-requisites for the course or have suitable knowledge and experience.

Cancellation or transfer of a course must be confirmed to go.courses ltd in writing. If a delegate withdraws from a course once it has started, or fails to attend, the full amount of the course fee is payable.

Courses booked where a date has not been allocated will be held in a training fund for a period of 12 months from the date of receiving a completed booking form or an official purchase order. Once booked a training fund is non refundable.

go.courses ltd will not supply equipment or course manuals for courses conducted at a customer’s site, unless otherwise stated.
Once a delegate is confirmed he or she cannot be transferred onto the same course at a different rate.

go.courses ltd reserves the right to cancel a course at any time without liability whatsoever, save for the return of course fees paid. All courses are subject to availability. Prices, dates and locations are subject to change without notice.
All course fees are subject to VAT at the current rate.

Laptop and equipment hire and labs
Cancellation of orders. If cancellation occurs within 5 working days of the delivery date, the Rentee shall incur a cancellation charge of 50% of the full Rental Charges. If cancellation occurs within 20 working days of the delivery date, the Rentee shall incur a cancellation charge of 25% of the Rental Charges. Once the laptops have been shipped & are in transit, the hire is deemed to have commenced & full payment would be required.

Where go.courses ltd has provided an IT course offsite which is not already listed within our public schedule the customer may be asked to provide their own laptops. Alternatively, go.courses ltd will provide each laptop at the rate of £45 per person per day of hire.

Where go.courses ltd is providing access to online course labs via a 3rd party we cannot be responsible for connectivity or other technical issues.  We will endeavour to provide a decent level of service but are not liable for issues outside of our control.

Special Offer Courses
Courses offered at a special offer rate are non refundable. Delegates can be transferred onto different dates providing they are outside our normal cancellation and transfer period.

Skills License
Skills License bookings must be paid for in advance. Skills license bookings do not include certain courses (ask us for details). All bookings must be confirmed in writing and normal cancellation, substitution, and transfer fees apply. A Skills License is valid for 12 months from date of purchase. All funds must be used in the 12 month period. If a license is used for specific courses then the license cannot be transferred to different courses unless agreed in writing. Any unused balance remaining at the end of this period will expire.

Skills Licenses offer exceptional value for money; As such it is not possible for us to provide places on all courses and all dates and all venues listed on our training websites. Your account manager will inform you of what is available under your license and help to manage your bookings as close to your expectations as we can. We will always try to accommodate your first choice but in some cases this may not be possible.  VMware advanced courses at not included within the skills license.

Skills license training days are priced at the rate of 25% deducted from the course retail price, unless agreed otherwise.

Skills Licenses have an overall target discount which during the term of the license we aim to achieve by placing delegates onto their desired course, from a range of partners around the UK. This means that in some instances you may attend your course with one partner yet on another occasion, the same course might be conducted with a different partner. We aim to offset some lower course discounts with higher discounts for in-house training or higher discounts where the vendor buy price is lower, but again we will always aim to achieve the overall skills license target discount during the agreed term. All courses are subject to availability.

Course vendors not included in the skills license include - Cisco Video Classes, Scrum Alliance Certified Scrum Master, Fast Track / Bootcamp courses, Brocade, EMC, IBM, VMware advanced courses. Other courses may be excluded and your account manager will confirm this with you.

Go courses has no control over 3rd party training schedules which means that the 3rd party can, without notice, change course prices, durations, content and timings.

All skills license bookings are non refundable.


Exams
All offer exam vouchers will expire within 6 months of receipt

Complaints
In the unlikely event that you need to register a complaint with us, your complaint must be sent in writing for the attention of Customer Services. Upon receipt of your written complaint we will aim to respond within 7 working days.

Warranty and Liability
Except as may otherwise be expressly provided in these Terms and Conditions and/or any applicable booking form, all warranties, conditions, terms, undertakings and representations of any kind whatsoever, express or implied, whether by statute, common law or otherwise, are hereby excluded by go.courses ltd to the fullest extent permitted by law and go.courses ltd shall have no other obligation, duty or liability whatsoever in contract, tort, statute or otherwise to the Customer. go.courses ltd represents and warrants that the services provided here under will be performed in a professional, workmanlike and skilful manner consistent with the professional standards and the general customs and practices of the Industry. go.courses ltd further warrants that the services delivered under any booking form will conform in all material respects to the written specifications related thereto. go.courses ltd maximum aggregate liability for any and all losses, claims, demands, damages, costs and/or expenses of any kind whatsoever go.courses ltd of or in connection with any booking form and/or these Terms and Conditions (whether in contract, tort, by statute or otherwise) shall not, in total, exceed the amount actually paid by the Customer to go.courses ltd for the services which are the subject of the booking form in question; provided however only in respect of claims based solely on go.courses ltd professional negligence in the performance of the services deliverable under any booking form, go.courses ltd total liability shall be limited to the amounts payable by the Customer to go.courses ltd for the services which are the subject of the booking form in question. For the avoidance of doubt, any liability of go.courses ltd for professional negligence shall be reduced by any other amounts (if any) payable to the Customer under this paragraph and any amounts due and owing to the Customer for any liability other than professional negligence shall be reduced by the amount (if any) of any professional negligence claims payable by go.courses ltd. Without prejudice to the generality of the foregoing, go.courses ltd shall not be liable to the Customer (whether in contract, tort, by statute or otherwise) for loss of profits and/or in respect of any incidental, consequential, special or indirect loss or damage or in connection with any booking form and/or these Terms and Conditions, including but not limited to: loss of use; loss of goodwill; loss of data; loss of information; loss of business; loss of goods; loss of anticipated savings; loss of revenue; and/or downtime. For the avoidance of doubt, nothing in these Terms and Conditions and/or any booking form shall restrict and/or exclude in any way go.courses ltd' liability for death or personal injury resulting from the negligence of go.courses ltd, its officers and/or employees; and/or fraudulent misrepresentation. The Customer is liable for any loss, damage or injury to go.courses ltd or appointed training provider staff or their property which may go.courses ltd or appointed provider whilst working at the Customer location and is to negligence or breach of statutory duty by the Customer. go.courses ltd shall, in the event of the unavailability of any member of its staff, use all reasonable endeavours to provide alternative personnel to provide the services, but cannot be held liable for its failure so to do. go.courses ltd accepts no liability for the failure of any third party hardware, software and/or systems which may be the subject of any go.courses ltd services: this includes failure to meet its operating specification and/or its ability to process date-specific data.

Data Protection Policy

go.courses ltd 

Definitions

GDPR means the General Data Protection Regulation.

Responsible Person Nick Ferro is responsible for data protection within the Go.courses ltd

Register of Systemsmeans a register of all systems or contexts in which personal data is processed by the Go.courses ltd.

1. Data protection principles

The Go.courses ltd is committed to processing data in accordance with its responsibilities under the GDPR. 

Article 5 of the GDPR requires that personal data shall be:

a.processed lawfully, fairly and in a transparent manner in relation to individuals;

b.collected for specified, explicit and legitimate purposes and not further processed in a manner that is incompatible with those purposes; further processing for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes shall not be considered to be incompatible with the initial purposes;

c.adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed;

d.accurate and, where necessary, kept up to date; every reasonable step must be taken to ensure that personal data that are inaccurate, having regard to the purposes for which they are processed, are erased or rectified without delay;

e.kept in a form which permits identification of data subjects for no longer than is necessary for the purposes for which the personal data are processed; personal data may be stored for longer periods insofar as the personal data will be processed solely for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes subject to implementation of the appropriate technical and organisational measures required by the GDPR in order to safeguard the rights and freedoms of individuals; and

f.processed in a manner that ensures appropriate security of the personal data, including protection against unauthorised or unlawful processing and against accidental loss, destruction or damage, using appropriate technical or organisational measures.”

2. General provisions

a.This policy applies to all personal data processed by the Go.courses ltd. 

b.The Responsible Person shall take responsibility for the Go.courses ltd’s ongoing compliance with this policy. 

c.This policy shall be reviewed at least annually. 

d.The Go.courses ltd shall register with the Information Commissioner’s Office as an organisation that processes personal data. 

3. Lawful, fair and transparent processing 

a.To ensure its processing of data is lawful, fair and transparent, the Go.courses ltd shall maintain a Register of Systems. 

b.The Register of Systems shall be reviewed at least annually. 

c.Individuals have the right to access their personal data and any such requests made to the go.courses ltd shall be dealt with in a timely manner. 

4. Lawful purposes

a.All data processed by the go.courses ltd must be done on one of the following lawful bases: consent, contract, legal obligation, vital interests, public task or legitimate interests (see ICO guidance for more information). 

b.The Go.courses ltd shall note the appropriate lawful basis in the Register of Systems.

c.Where consent is relied upon as a lawful basis for processing data, evidence of opt-in  consent shall be kept with the personal data. 

d.Where communications are sent to individuals based on their consent, the option for the individual to revoke their consent should be clearly available and systems should be in place to ensure such revocation is reflected accurately in the Go.courses ltd’s systems.  

5. Data minimisation

a.The Go.courses ltd shall ensure that personal data are adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed. 

6. Accuracy

a.The Go.courses ltd shall take reasonable steps to ensure personal data is accurate. 

b.Where necessary for the lawful basis on which data is processed, steps shall be put in place to ensure that personal data is kept up to date. 

7. Archiving / removal

a.To ensure that personal data is kept for no longer than necessary, the Go.courses ltd shall put in place an archiving policy for each area in which personal data is processed and review this process annually. 

b.The archiving policy shall consider what data should/must be retained, for how long, and why. 

8. Security

a.The Go.courses ltd shall ensure that personal data is stored securely using modern software that is kept-up-to-date.  

b.Access to personal data shall be limited to personnel who need access and appropriate security should be in place to avoid unauthorised sharing of information. 

c.When personal data is deleted this should be done safely such that the data is irrecoverable. 

d.Appropriate back-up and disaster recovery solutions shall be in place. 

9. Breach

In the event of a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to, personal data, the Go.courses ltd shall promptly assess the risk to people’s rights and freedoms and if appropriate report this breach to the ICO (more information on the ICO website).
